1. Acceptance of Terms
By accessing, browsing, or using the Krosspost platform ("Service") at https://krosspost.ai, or by clicking "I Accept", "Sign Up", or any similar affirmative action, you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any other policies referenced herein.
If you do not agree to these Terms, you are not permitted to access or use the Service. These Terms constitute a legally binding agreement between you ("User", "you", "your") and Krosspost ("Company", "we", "us", "our").
Our Privacy Policy is incorporated into and forms an integral part of these Terms. Please read it carefully for information on how we collect, use, store, and disclose your personal data.
2. Definitions
- "Service" means the Krosspost platform, including the website, web application, APIs, mobile applications (if any), and all related tools, features, automations, and integrations.
- "User" or "you" means any individual or entity that accesses or uses the Service.
- "User Content" means any text, images, videos, audio, documents, messages, posts, comments, or other material that you upload, submit, publish, or transmit through the Service.
- "Platform(s)" means third-party social media and communication platforms integrated with the Service, including but not limited to Instagram, Facebook, WhatsApp, X (Twitter), LinkedIn, YouTube, Reddit, Telegram, Discord, Spotify, and Gmail.
- "Automation" means any automated task, scheduled post, AI-generated response, auto-reply, or workflow executed through the Service on connected Platforms.
- "AI-Generated Content" means any text, caption, reply, message, or other content produced by artificial intelligence models (such as Google Gemini, Groq, or DeepSeek) through the Service.
- "Kavach" means Krosspost's proprietary account safety monitoring engine that analyses messaging behaviour and engagement patterns to assess account health risk.

4. Service Description
Krosspost is a social media management, automation, and AI-powered content platform. The Service includes, but is not limited to, the following features:
- Social Media Cross-Posting & Scheduling: Create, schedule, and publish content across multiple social media platforms (Instagram, Facebook, X, LinkedIn, YouTube, Reddit, Telegram, Discord) from a single dashboard.
- AI-Powered Content Generation: Generate post captions, message drafts, and content suggestions using third-party AI models (Google Gemini, Groq, DeepSeek).
- Instagram DM Automation & AI Auto-Replies: Configure automated responses to Instagram Direct Messages based on your Knowledge Base, FAQs, and AI-driven conversation flows.
- AI Comment Response System: Set up AI-powered automatic replies to Instagram comments using your custom Knowledge Base and prompt configurations.
- WhatsApp Business Messaging: Send templated and custom WhatsApp messages via WhatsApp Business API, with delivery tracking and analytics.
- Knowledge Base & AI Agent Builder: Create and manage knowledge bases with FAQs, business data, and documents to train AI agents for automated responses.
- Kavach Account Safety Monitoring: Monitor your Instagram and WhatsApp accounts for risk signals, receive safety scores, and get recommendations to protect your accounts from platform restrictions.
- Follower Analysis & Analytics: Analyse follower demographics, engagement metrics, and growth trends for your connected accounts.
- Content Automations: Automate content cross-posting from Google Business Reviews, Spotify podcast episodes, YouTube video alerts, and Medium RSS feeds.
- Story Automations: Automated Instagram story responses and interactions.
- Post Calendar: Visual calendar for planning and managing scheduled content across platforms.
The Company reserves the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice.
5. Eligibility
To use the Service, you must:
- Be at least 18 years of age.
- Have the legal capacity to enter into a binding agreement under the Indian Contract Act, 1872.
- Not have been previously suspended or removed from the Service.
- Ensure that your registration and use of the Service comply with all applicable laws and regulations in your jurisdiction.
By agreeing to these Terms, you represent and warrant that you meet all eligibility requirements stated above.
6. Account Registration & Security
To access the Service's features, you must create an account by providing accurate and complete information, including your name and email address. You agree to:
- Provide truthful, accurate, and up-to-date information during registration and maintain it as such.
- Keep your password and account credentials secure and confidential.
- Accept sole responsibility for all activities that occur under your account.
- Notify us immediately at help@krosspost.ai if you suspect any unauthorized access to or use of your account.
The Company is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.
7. Subscription, Payments & Refunds
7.1 Subscription Plans
The Service offers free and premium subscription plans. Premium features require payment of applicable fees. You will have the opportunity to review and accept the fees before confirming payment. Plan options and pricing are available on our Pricing Page.
7.2 Payment Processing
All payments are processed in Indian Rupees (INR) through Razorpay, a PCI-DSS Level 1 certified payment gateway. Applicable Goods and Services Tax (GST) will be added to the base subscription price as per Indian tax laws.
7.3 Pricing Changes
The Company reserves the right to modify subscription fees at any time. Changes will be communicated via email at least 15 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised pricing.
7.4 Refund Policy
Subscription fees are generally non-refundable once the service period has commenced. However, if you cancel your subscription before utilizing any premium features during the current billing cycle, you may be eligible for a pro-rata refund of the unused portion. Refund requests must be submitted to help@krosspost.ai within 7 days of payment. Each request will be evaluated on a case-by-case basis.
8. User Content & License Grant
8.1 Your Intellectual Property
You retain all intellectual property rights, including copyrights, over your User Content. Krosspost does not claim ownership of any User Content you create, upload, or publish through the Service.
8.2 License to Krosspost
By submitting User Content to or through the Service, you grant Krosspost a non-exclusive, royalty-free, worldwide, non-sublicensable, limited license to access, host, store, transfer, display, reproduce, and modify (solely for the purpose of formatting for display and distribution) your User Content, in whole or in part, as necessary to provide and operate the Service. This license terminates when you delete your User Content or your account.
8.3 Content Responsibility
You are solely responsible for the User Content you publish through the Service. You represent and warrant that your User Content does not violate any applicable law, third-party intellectual property rights, or Platform terms of service.
9. AI-Generated Content Disclaimer
⚠️ Important Notice Regarding AI-Generated Content
The Service uses third-party AI models (including Google Gemini, Groq, and DeepSeek) to generate content such as post captions, comment replies, DM responses, and Knowledge Base answers. By using these features, you acknowledge and agree that:
- No guarantee of accuracy: AI-generated content may contain errors, inaccuracies, or inappropriate material. Krosspost does not warrant the accuracy, completeness, or suitability of any AI-generated output.
- User review responsibility: You are solely responsible for reviewing, editing, and approving all AI-generated content before it is published, sent, or shared on any Platform. Krosspost shall not be held liable for any content published without adequate review.
- Platform compliance: You must ensure that all AI-generated content complies with the terms of service, community guidelines, and content policies of the respective Platforms where it is published.
- No legal or professional advice: AI-generated content does not constitute legal, medical, financial, or professional advice of any kind.
- Liability: Krosspost, its founders, employees, and contractors are not liable for any damages, losses, penalties, or consequences arising from the use of AI-generated content, including but not limited to Platform violations, third-party claims, or regulatory actions.
10. Platform Automation & Third-Party Platform Risks
🚨 Critical Disclaimer — Please Read Carefully
10.1 Use of Official APIs
Krosspost interacts with third-party Platforms exclusively through their official, authorized APIs (including Meta Graph API, Instagram API, WhatsApp Business Cloud API, YouTube Data API, X API v2, LinkedIn API, and others). We do not use unauthorized browser bots, screen scrapers, password-sharing mechanisms, or any other method that bypasses Platform security systems.
10.2 Meta Rate Limit Compliance
We implement and enforce Meta's rate-limiting guidelines through our internal rate-limit engine, which includes:
- Configurable hourly and daily limits on automated comments and DMs
- Real-time usage tracking with automatic blocking when limits are reached
- Email alerts when rate limits are approaching or reached
- Automatic rollback of consumed quota when requests fail
10.3 Meta Opt-Out & Private Reply Compliance
In compliance with Meta's messaging policies, we:
- Automatically detect opt-out keywords ("stop", "unsubscribe", "opt out", "remove me", etc.) in inbound messages and suppress all future automated messaging to that recipient
- Maintain a private reply ledger to ensure only one automated private reply is sent per comment, as required by Meta
- Support Data Subject Access Requests (DSAR) for data export and purging
10.4 Disclaimer of Liability for Platform Actions
BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO THE FOLLOWING:
- Krosspost is NOT responsible for any account restrictions, shadowbans, temporary locks, content removals, feature limitations, or permanent suspensions imposed by Instagram, Facebook, WhatsApp, or any other third-party Platform as a result of, or in connection with, your use of the Service, including but not limited to:
- Use of automation features (DM auto-replies, comment auto-responses, scheduled posting)
- AI-generated content published on Platforms
- Bulk messaging or high-volume engagement activities
- Content that triggers Platform spam detection algorithms
- Platform algorithm updates or policy changes
- API access revocations or rate limit enforcement by Platforms
- While Krosspost follows Meta's rate limits, opt-out policies, and API guidelines, we cannot and do not guarantee immunity from Platform enforcement actions. Meta and other Platforms retain sole discretion over their content moderation, algorithm changes, and account enforcement decisions.
- The User is solely and entirely responsible for any bans, restrictions, penalties, or adverse consequences imposed by any Platform on the User's account(s), regardless of whether such actions result from the use of Krosspost's features or otherwise.
- You use automation and AI features at your own risk. Krosspost provides tools designed to facilitate social media management, but the responsibility for how those tools are used — and the consequences thereof — rests entirely with you.
10.5 Platform Terms Compliance
You are independently responsible for reading, understanding, and complying with the Terms of Service and Community Guidelines of each Platform you connect to Krosspost, including but not limited to:
If you wish to revoke Krosspost's access to your Google/YouTube data, you can do so from the Google Security Settings. By using YouTube API clients through our Service, you are agreeing to be bound by the YouTube Terms of Service.
11. WhatsApp Business API — Specific Terms
If you use the WhatsApp Business messaging features of the Service, you additionally agree to the following:
- You must obtain proper consent from recipients before sending them messages via the WhatsApp Business API.
- You must respect Meta's 24-hour messaging window for customer-initiated conversations. Promotional messages outside this window must use approved message templates.
- You must not send spam, unsolicited bulk messages, or content that violates the WhatsApp Business Policy.
- You acknowledge that Meta may restrict or revoke your WhatsApp Business API access based on message quality, user feedback, or policy violations. Krosspost is not responsible for such actions.
- You are responsible for the content of all messages sent through the Service, including template messages and automated responses.
12. License & User Restrictions
12.1 License Grant
Subject to your ongoing and complete compliance with these Terms, Krosspost grants you a non-transferable, non-assignable, limited, non-exclusive, revocable license to use the Service solely as permitted in these Terms and at the level of service for which you have paid all applicable fees.
12.2 Restrictions
You may not and may not allow others to:
- Sell, rent, lease, sublicense, or assign the use of your account to others.
- Reproduce, distribute, publicly display, or publicly perform the Service.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
- Modify, adapt, translate, or create derivative works based on the Service.
- Interfere with or disrupt any aspect of the Service, including security or access control mechanisms.
- Use the Service to upload, transmit, or distribute content that infringes upon any third party's intellectual property rights.
- Circumvent or attempt to circumvent any rate limits, usage restrictions, or safety mechanisms implemented by the Service.
- Use the Service in a manner that violates the terms of service of any connected Platform.
13. Prohibited Conduct
By using the Service, you agree not to:
- Use the Service for any illegal purpose or in violation of any local, state, national, or international law, including but not limited to the Information Technology Act, 2000, the Indian Penal Code, and the Consumer Protection Act, 2019.
- Send spam, unsolicited messages, or engage in aggressive automated engagement patterns that may trigger Platform spam detection.
- Violate or encourage others to violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights.
- Engage in fraudulent activity, including impersonating another person or entity, claiming false affiliations, or providing false information.
- Attempt to circumvent Krosspost's rate-limiting systems, Kavach safety recommendations, or any other protective mechanisms.
- Use the Service to distribute malware, phishing links, or any content designed to harm others.
- Upload or distribute content that is defamatory, obscene, pornographic, hateful, or promotes violence or discrimination.
- Access the Service through automated means (bots, scrapers) other than the interfaces provided by Krosspost.
14. Intellectual Property Rights
14.1 Company's Intellectual Property
The Service, including all its components — software, design, logos, trademarks, trade names, user interface, documentation, Kavach algorithms, AI prompt systems, and all related intellectual property — is owned by and proprietary to Krosspost. All elements of the Service are protected by copyright, trademark, trade secret, and other intellectual property laws of India and international treaties.
14.2 User's Intellectual Property
You retain all intellectual property rights over your User Content. Krosspost claims no ownership over any content you create, upload, or publish through the Service.
15. Data Protection & DPDPA Compliance
Krosspost processes personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and all applicable Indian data protection laws. For complete information on how we collect, use, store, and protect your personal data, please refer to our Privacy Policy.
Key data protection commitments include:
- Purpose-limited data processing with explicit consent
- Data Principal rights (access, correction, erasure, consent withdrawal)
- Data breach notification to the Data Protection Board and affected individuals
- Appointed Grievance Officer for complaint resolution
- Support for Meta Data Subject Access Requests (DSAR)
16. Disclaimers & Limitation of Liability
16.1 "As Is" Provision
THE SERVICE AND ALL MATERIALS, CONTENT, TOOLS, AND FEATURES AVAILABLE THROUGH THE SERVICE ARE PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- ANY WARRANTIES AS TO THE AVAILABILITY, ACCURACY, RELIABILITY, OR COMPLETENESS OF THE SERVICE, AI-GENERATED CONTENT, OR ANALYTICS DATA.
- ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR VIRUS-FREE.
- ANY WARRANTY REGARDING THE OUTCOMES, RESULTS, OR PERFORMANCE OF YOUR SOCIAL MEDIA ACCOUNTS WHEN USING THE SERVICE.
16.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Loss of data or data corruption
- Loss of social media followers, reach, engagement, or account standing
- Account bans, restrictions, or suspensions imposed by any Platform
- Damages arising from AI-generated content, automated messaging, or any automation feature
- Damages arising from unauthorized access to your account or data breach
- Damages arising from Platform API changes, outages, or deprecations
IN ANY EVENT, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO THE COMPANY IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR INR 5,000 (FIVE THOUSAND INDIAN RUPEES), WHICHEVER IS GREATER.
17. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its founders, directors, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:
- Your use or misuse of the Service.
- Your violation of these Terms or any applicable law or regulation.
- Your User Content or AI-generated content published through the Service.
- Any Platform restrictions, bans, or penalties imposed on your account(s) in connection with your use of the Service.
- Your violation of any third-party rights, including intellectual property or privacy rights.
- Any claim by a third party arising from messages or content sent through the WhatsApp Business API or Instagram DM/comment automation features.
18. Termination
18.1 Termination by You
You may terminate your account and stop using the Service at any time by deleting your account through the Settings page or by contacting us. Upon termination, your right to use the Service ceases immediately.
18.2 Termination by Krosspost
The Company reserves the right to suspend or terminate your access to the Service, without prior notice, for any reason, including but not limited to:
- Breach of these Terms or any applicable policy.
- Engaging in prohibited conduct, spam, or abusive behavior.
- Request or order from law enforcement or a government authority.
- Extended periods of inactivity (180+ days without login).
- Non-payment of subscription fees or failed recurring payments.
18.3 Effect of Termination
Upon termination: (a) your license to use the Service is immediately revoked; (b) you must cease all use of the Service; (c) your data will be handled in accordance with our Privacy Policy and data retention practices; (d) no refund shall be issued for any pre-paid subscription fees for the current billing cycle, except as expressly stated in Section 7.4.
19. Modification of Terms & Service
19.1 Changes to Terms
The Company reserves the right to modify these Terms at any time. If we make material changes, we will notify you via the email address associated with your account and update the "Last Updated" date at the top of these Terms. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
19.2 Changes to Service
The Company may modify, suspend, or discontinue any part of the Service at any time, temporarily or permanently, without prior notice. This includes adding, changing, or removing features, integrations, or Platform support. The Company is not liable for any modification, suspension, or discontinuation of the Service.
20. Governing Law & Dispute Resolution
20.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to the Indian Contract Act, 1872, the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Consumer Protection Act, 2019, without regard to conflict of law principles.
20.2 Jurisdiction
Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in India.
20.3 Arbitration
Before filing any legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at help@krosspost.ai. If the dispute is not resolved within 30 days, either party may initiate binding arbitration under the Arbitration and Conciliation Act, 1996, to be conducted in India. The arbitration shall be conducted by a sole arbitrator mutually agreed upon by both parties.
21. General Terms
21.1 Entire Agreement
These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and Krosspost regarding your use of the Service.
21.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
21.3 Waiver
The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
21.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. The Company may assign these Terms at any time without notice or consent.
21.5 Force Majeure
The Company shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, Platform API changes, internet disruptions, or power failures.
21.6 Interpretation
The word "including" as used throughout these Terms signifies "including but not limited to." Section headings are for convenience only and have no legal effect.
